New ANVISA Regulatory Framework for Cannabis (2026)
RDC nº 1.012/2026
Establishes the requirements for the cultivation of cannabis without a THC limit, intended exclusively for scientific research purposes.
RDC nº 1.013/2026
Establishes the requirements for the cultivation of Cannabis sativa L. with THC ≤0.3%, intended exclusively for medical and pharmaceutical purposes, including the manufacture of cannabis-based medicinal products regulated under RDC nº 1.015/2026, as well as research.
RDC nº 1.014/2026
Creates a Regulatory Sandbox (experimental regulatory environment) to evaluate controlled models for cannabis cultivation, the production of plant-derived Active Pharmaceutical Ingredients (APIs), and the production and distribution of cannabis preparations by non-profit patient associations for their members.
RDC nº 1.015/2026
Establishes the conditions and procedures for obtaining sanitary authorization for the manufacture, importation, and commercialization of cannabis-based medicinal products, replacing the previous framework established by RDC nº 327/2019.
Approval context:
These resolutions were approved during the 1st Ordinary Public Meeting of ANVISA’s Board of Directors (Dicol) in 2026, held on January 28, 2026, with the stated goal of aligning regulation with healthcare realities, reducing regulatory asymmetries, strengthening health surveillance capacity, and providing greater predictability to the regulated sector.
Implementation of these regulatory measures is scheduled to begin August 4, 2026, marking an important step in the development of Brazil’s regulated medical cannabis industry.
Matthew Bean is an American-born entrepreneur and licensed psychologist in Brazil (CRP-MG 04/85314) and the founder of AmericannaBrasil, a company focused on developing medical cannabis cultivation and primary processing infrastructure in Brazil. His work centers on introducing American cultivation standards, controlled indoor production systems, and solventless processing techniques to Brazil’s emerging regulated cannabis sector.
Matthew earned his degree in Psychology from Universidade de Uberaba (UNIUBE), where his thesis, “A Dor que Perdura: Estudo Sobre o Luto Complicado,” examined the psychological dimensions of complicated grief and its relationship to emotional trauma and substance use behaviors. His professional perspective is influenced by behavioral science and humanistic psychology, emphasizing evidence-based approaches to mental health and emerging therapeutic fields.
Living in Brazil for over twelve years, Matthew has also developed extensive entrepreneurial experience, including residential construction and renovation projects totaling approximately $600,000 USD in infrastructure development.
He also holds one of the rare judicial authorizations in Brazil allowing personal medical cannabis cultivation. Through authorization granted by the Superior Tribunal de Justiça (STJ), he is permitted to cultivate up to 158 plants per year and produce extracts and medicines derived from his cultivation for personal therapeutic use. This authorization provides him with practical experience working with the entire cannabis plant—from cultivation to extraction—within Brazil’s evolving legal framework.
Through AmericannaBrasil, Matthew aims to help introduce professional cultivation infrastructure and responsible production standards to Brazil’s developing medical cannabis market.
Dr. Thaís Oliveira Ramalho Bean is a Brazilian agronomist and plant scientist specializing in plant pathology, plant biotechnology, and genetic variability of plant viruses. She holds a degree in Agronomy from the Federal University of Lavras (UFLA), where she also completed her Master’s and PhD in Agronomy with a focus on Plant Pathology. During her doctoral research, she conducted part of her studies at the University of Kentucky (USA).
Dr. Bean currently serves as a professor of Agronomy at a leading public Brazilian agricultural university, where she teaches courses in Agroecology, Plant Pathology, Seed Technology, and Plant Breeding. She is actively involved in research collaborations with private agricultural companies and research institutions, contributing to projects related to crop protection, plant health, microbiology, and agricultural biotechnology.
Her scientific work includes research on plant-virus interactions, genomic sequencing, molecular and serological diagnostics, genetic transformation, and pathogen-host interactions, with experience using advanced laboratory techniques such as fluorescent protein analysis and electron microscopy. She has also participated in international research projects supported by organizations such as the U.S. National Science Foundation, studying plant viral diseases affecting important crops.
Through her academic and research work, Dr. Bean brings strong expertise in plant biotechnology, disease diagnostics, crop genetics, and agricultural innovation, supporting the scientific development of controlled-environment agriculture and biotechnology initiatives.
